PROBATE & ESTATE ADMINISTRATION
Probate is the court-supervised process of settling a deceased person’s final affairs. It requires appointment of the executor named in the will, or if the person died without a will, an heir serves as administrator. Estate administration refers to any instance where a person is managing someone else’s assets, such as an agent under a power of attorney.
ADULT GUARDIANSHIP
A guardian is needed for adults who are unable to make decisions for themselves. Sometimes the inability is due to diseases associated with aging, like dementia, but it can also happen to younger adults with unexpected illness or injury. If the incapacitated loved one doesn’t have an estate plan, you may need a guardianship or conservatorship to make medical decisions or perform financial transactions on their behalf. A guardian or conservator can only be appointed by the court.
